Section 1 – Website Terms and Conditions of Use

The website www.hebdraulique.ca as well as the contents therein (hereinafter collectively “the website”) are provided to the public as a free service by Hebdraulique Inc. (hereinafter “Hebdraulique”). Before using the website, please read closely the following terms and conditions governing such use. By accessing the website, you accept these terms and conditions and undertake to abide by them. If you do not agree to these terms and conditions, you must stop all use of the website.

The website presents the goods and services of Hebdraulique, operating throughout Canada, and Hebdraulique N.L., operating in the province of Newfoundland and Labrador. Hebdraulique and Hebdraulique N.L. are independent corporations. Hebdraulique is a corporation registered and having its head office in the province of Québec, Canada. Hebdraulique N.L. is a corporation registered and having its head office in the province of Newfoundland and Labrador, Canada

1.1 Modifications

Hebdraulique reserves the right to modify, add, or remove any information or content from the website at any time and without notice.

1.2 Applicable Laws and Jurisdictions

The website and your use thereof are governed by the laws applicable in the Province of Québec, Canada. Any dispute in relation with the website and your use thereof are subject to the exclusive jurisdiction of the tribunals for the judicial district of Montréal, Province of Québec, Canada.

1.3 Hosting

The website is hosted in the Province of Québec, Canada, and is managed from Hebdraulique’s offices located in Montréal, Province of Québec, Canada.

1.4 Intellectual Property and Copyright

All contents of the website (text, logos, screen captures, concepts, graphics, pictures, information, documents, and others) as well as the choice, layout, and display of these contents are the exclusive property of Hebdraulique and are protected by Canadian and international laws governing copyright.

The trade-marks and logos HEBDRAULIQUE®, HEBTM, and PRO-PULSERTM are trade-marks of Hebdraulique. Other trade-marks and logos appearing on the website are trade-marks of their respective owners and are used on the website with their owner’s permission.

You may copy, download, and print the documents available on the website for personal and non-commercial use only. Modifying or redistributing these documents is strictly prohibited. All copyrights, trade-marks, service marks, or other notice of intellectual property appearing on these documents must be reproduced integrally as they appears on original documents.

1.5 Link to Third-Party Website

As a service to internet users, Hebdraulique may provide hyperlinks to other websites. Such hyperlinked websites are not under Hebdraulique’s control and, as such, Hebdraulique may not be held liable for the contents of any website hyperlinked to the website. The fact that Hebdraulique provides hyperlinks on its website does not constitute an endorsement of the content of such website by Hebdraulique.

1.6 Communication through the Website

All comments, reactions, suggestions and other information that you provide to Hebdraulique through the website or in association therewith will be considered public and non-confidential. By submitting such information to Hebdraulique, you acknowledge and agree that Hebdraulique may use it at its sole discretion, including to conceive, create, and market products or services, without any restriction or indemnity.

However, your personal information is protected by our privacy policy set out below.

1.7 No Warranty

The website is provided “as is”, without any warranty whatsoever. You acknowledge and agree to use the website at your own risk. You renounce to hold Hebdraulique liable for any error, virus or other that may slip through any safeguards put in place. Furthermore, Hebdraulique may not be held liable for any damage resulting from the use of the website, including loss of data, inability to use data or loss of profit. Hebdraulique offers no warranty that the website will be available on a continuing basis.

2.1 Application of Privacy Policy

This privacy policy is intended to help you understand how Hebdraulique collects, uses and safeguards the personal and other information you provide through our website. It does not apply to the use or disclosure of personal and other information that is collected or obtained by us through other means.

2.2 Your Account

Your Responsibilities. To protect your account from unauthorized activity, you should keep your password confidential and restrict access to your computer and any mobile devices through which your account may be accessed. You are responsible for all activity on or through your account. We will not be liable for damages or loss arising from your failure to maintain the confidentiality of your password or to adequately restrict access to your account. You represent and warrant that all information that you provide in connection with your account is and shall be accurate, truthful, current and complete. We reserve the right to deny, deactivate or terminate your account at our discretion.

Breach of Security. You accept all risk that your account may be accessed without your permission. If you discover or suspect that the security of your account has been breached, please let us know as soon as possible.

2.3 Information We Collect and Use

Your Personal Information. When you place an order for a Product, we need to know your name, email and mailing addresses, and your billing information so that we can fill, confirm and ship your order, notify you of your order status and process your payment. We may also request some of this same information from you when you ask a question or make a comment through our website in order for us to respond appropriately. For administration purposes, our website may collect your IP address or domain name, referring web page, browser type, mobile device type, device operating system, device settings, geolocation data and non-personal information about the way you use your device or this site (such as the length of time spent or the pages accessed while visiting this site). We may use third-party website analytics tools and embedded tracking codes that collect information about visitor traffic on our site to collect information about you.

Disclosure of Information to Third Parties. We don't rent or sell to others any information about our customers. We do not grant permission to third parties to collect information regarding the online activities of our website users over time and across different websites when they visit our website. However, we may provide your personal information to third parties who provide services on our behalf, such as the companies engaged to deliver your order and process your payment. We also reserve the right to disclose without notice to you any information in our possession if we believe we are required to do so by law, to protect or defend our rights or property, or to respond to an emergency.

Use By Minors Prohibited. Our website is not intended for use by and Hebdraulique does not intend to collect personal information from individuals under 18 years of age. Individuals under 18 years of age are directed to not use our website, whether to purchase products, submit personal information or otherwise.

These permissions may include (i) granting us access to the camera and photos, videos and other media files on your device, and (ii) allowing us to send push notifications to you. Hebdraulique‘s Responsibility. The security of your information is important to us. While we endeavor to use reasonable efforts to safeguard the confidentiality of your information, the Internet and other e-commerce channels are not totally secure. Due to the possibility of transmission errors, hacking or other unauthorized third-party activities, we cannot guarantee that personal data transmitted to our website will remain secure. If we become aware of a security breach involving any such data, Hebdraulique will make all legally required disclosures consistent with our ability to determine the scope of the breach, our need to restore the integrity of the system and the needs of law enforcement.

Credit Card Information. Whenever we transmit your credit card information over the Internet, we use industry standard encryption for all pages containing private information pertaining to your shipments. Your full credit card number is never displayed when you use our website. When you use a saved credit card, we only include the last four digits of the credit card number on the order page so that you can tell which credit card you used.

Our website is operated by Hebdraulique Inc. from our offices in the province of Québec, Canada. Information that you submit to us from outside the province of Québec, Canada through the website will be transmitted to the province of Québec, Canada (including to our service providers located in the province of Québec, Canada), which may have privacy laws that are less protective than the privacy laws of the jurisdiction in which you reside. By using our website, you consent to this transfer. We make no representation that our website is appropriate or available for use in locations outside the province of Québec, Canada.

2.8 Changes in Privacy Policy

We reserve the right to change the privacy policy at any time by providing notice to you. We will notify you of changes to the privacy policy by one or more of the following: (i) providing you with an electronic notification through our website, by email or other means of electronic communication or through any of our e-commerce functions, or (ii) making a revision to the privacy policy and changing the Terms and Conditions Version Date appearing below. By clicking the “I agree” button in connection with an electronic notification of a change, by using the website or by purchasing a product from us after the new version date, you signify your acceptance of the revised privacy policy.

Section 3 – Terms and Conditions of Sales

3.1 General

All sales are governed by our General Terms and Conditions of Sales, subject to specific terms and conditions.

3.2 Online Sales

The Online Terms and Conditions of Sale below apply to any sale of goods by Hebdraulique through its website www.hebdraulique.ca. The online terms and conditions of sale are suppletive to the General Terms and Conditions of Sale.

3.2.1 Shipping Policy

  • Local Pickup: In-store pickup is available at our Montréal (Saint-Léonard) service center Monday to Friday, 8am to 6pm, and Saturday 8am to noon.
  • Shipping in Canada (excepted Newfoundland-and-Labrador): Orders are generally shipped within 48 hours (Monday to Friday) using Canada Post. Canada Post’s delivery standard is 2–7 days, but they report delays are occurring. Shipping rates are set by Canada Post according to weight and package dimensions.
  • Shipping in Newfoundland-and-Labrador: Delivery for online sales is not currently available in the province of Newfoundland-and-Labrador. If you are located within this province, please contact our local subsidiary by email at hebnl@hebdraulique.ca.
  • Shipping Outside Canada: Delivery for online sales is only available within the territory of Canada. If you are located outside Canada, please contact us by email at web@hebdraulique.ca.

3.2.2 Warranty

All new goods are warranted against any material and/or workmanship defects for a period of one (1) year from the date of sale. Hebdraulique’s obligation under this warranty is limited to repairing or replacing, at its discretion and at its place of business, any returned item that, after inspection, shall have been confirmed defective. Hebdraulique disclaims any other warranty, of any nature whatsoever, explicit or implicit. Hebdraulique is not liable for any loss, damages, repair costs, shipping costs, or any other indirect, special, or consequential damages, as regards the goods or services sold. If a defective product cannot be repaired, replaced, or exchanged, it will be reimbursed on the credit card used for purchase.

3.2.3 Return, Exchange, and Reimbursement Policy

All sales are final. Only returns pre-authorized by Hebdraulique are accepted. To obtain a return authorization, please contact us by email at web@hebdraulique.ca. Any returned product must be in its original packaging, in good condition and suitable for resale. Approval of a return is conditional to inspection. Items must be returned to 8410, Champ d’eau Street in Saint-Léonard, province of Québec, Canada, H1P 1Y3. Shipping is at customer’s expense. No return shall be accepted beyond a period of one (1) year after the date of sale. No return shall be accepted on hose and piping assemblies, used items, non-inventory items (special orders) and any other item sold as “non-returnable”. Return fees (minimum 15% of sale price) apply. Authorized returns will be reimbursed on the credit card used for purchase.

3.2.4 Payment

The price of goods sold is payable upon order confirmation.

3.2.5 Place of Sale

Any online sale is considered to be made in Montréal, province de Québec, Canada.

3.2.6 Currency

All prices are payable in Canadian dollars (CAD).

3.2.7 Delivery Date

Delivery date will be set upon order confirmation according to the shipping policy above.

3.3 Newfoundland-and-Labrador Sales

All sales through the Mount Pearl, NL service center are governed exclusively by Hebdraulique N.L.’s General Terms and Conditions of Sales.
